Terms and Conditions

In accordance with the provisions of Articles 6-III and 19 of Law n°2004-575 of 21 June 2004 for Confidence in the Digital Economy, known as L.C.E.N., users of the site www.locnet.org, hereinafter referred to as the "Site", are informed of the present legal notice. 

Connection and browsing on the Site by the user implies full and unreserved acceptance of these legal notices. 

These are accessible on the Site under the heading "Legal notices". 


1. THE PUBLISHER 

The Site is published by the LoCNet association, subsequently named "Association", declared to the prefecture of Muret (31) under the number W313034062, whose head office is located in Toulouse; e-mail address: contact@locnet.org. 

The Director of the publication is Roxanne LEBERGER, in her capacity as Executive Director.


2. THE HOST

The host of the Site is the Strato Company, whose registered office is located at Pascalstrasse 10, 10587 Berlin, Germany; Fax: 0825742360. 


3. ACCESS TO THE SITE 

The Site is accessible from any place, 7 days a week, 24 hours a day, except in cases of force majeure, scheduled or unscheduled interruptions that may arise from a need for maintenance. In the event of modification, interruption or suspension of services, the Association cannot be held responsible.

Users who are not partners of the Association do not have access to the reserved services (database, certain reports). To do so, he or she must, as a representative of a legal entity, fill in a registration form. By agreeing to register for the reserved services, the partner user undertakes to provide true and accurate information concerning the contact details of the legal entity, in particular its email address. In order to access the services, the user must then identify himself using the user name and password that he will have established himself. 

Any regularly registered Partner User may also request to unsubscribe by going to the dedicated page on his personal space. This will be effective within a reasonable period of time.


4. USER PRIVACY

The Association believes that user privacy, especially on the web, is a fundamental right and therefore strives to ensure that online security is guaranteed as rigorously as possible.

This policy applies to this Site. It does not apply to pages hosted by other organisations to which the Site may link via hyperlinks, and whose privacy policies may differ.


5. DATA COLLECTION 

The Site assures the user of the collection and processing of personal information with respect for privacy in accordance with the law n°78-17 of January 6, 1978 relating to data processing, files and freedoms. The Association is exempt from making a declaration to the CNIL, the administrative authority accepting complaints.

In accordance with the French Data Protection Act of 6 January 1978, the user has the right to access, rectify, delete and oppose his or her personal data. The user exercises this right by sending an e-mail to the e-mail address contact@locnet.org. He/she may also contact this email address if he/she has any questions concerning the protection of personal data.

The Association only communicates the personal information it collects to its internal services and to its service providers and possibly their staff with regard to the execution of the services entrusted to them and which they must carry out on behalf of the Association (email routing, donation system, etc.).

The Association only keeps the personal information of users for the time necessary to achieve the purposes for which it was collected, in compliance with the legislation in force. 


6. INTELLECTUAL PROPERTY 

Unless otherwise stated, you may use and distribute at your convenience the texts, photos and videos on the site that are accessible to the public, under the terms of the Creative Commons Attribution-Noncommercial 3.0 France Licence. However, be careful with content that does not belong to the Association and which is therefore credited on our sites: make sure you have the rights and/or quote the authors. 

Any content belonging to the services reserved for partners (not public, requiring registration) must request prior permission from the Association for any reproduction, publication, copy of the various contents. The user undertakes to use the contents of the site's reserved services in a strictly private context, any use for commercial and advertising purposes is strictly prohibited. 

The association's logo is to be credited to the Association, and is protected by the Intellectual Property Code and more particularly by copyright. 

Any total or partial representation of this site by any process whatsoever, without the express authorisation of the website operator, would constitute an infringement punishable under article L 335-2 et seq. of the French Intellectual Property Code. 


7. RESPONSIBILITY

The sources of the information disseminated on the www.locnet.org site are deemed reliable but the Site does not guarantee that it is free of defects, errors or omissions.

The information provided is presented for general information purposes only and has no contractual value. Despite regular updates, the www.locnet.org site cannot be held responsible for changes in administrative and legal provisions occurring after publication. Similarly, the site cannot be held responsible for the use and interpretation of the information contained in this site. 

The User makes sure to keep his/her password secret. Any disclosure of the password, whatever its form, is prohibited. The User assumes the risks associated with the use of his login and password. The site declines all responsibility.

The www.locnet.org site cannot be held responsible for any viruses that may infect the Internet user's computer or any other computer equipment, following use, access or downloading from this site.

The Site cannot be held liable in the event of force majeure or the unforeseeable and insurmountable fact of a third party.

Hypertext links contained on the Site may refer to other websites or other Internet sources. 

Insofar as the Association cannot control these external sites and sources, you acknowledge that the Association cannot be held responsible for the availability of these external sites and sources, and cannot accept any responsibility for the content, advertising, products, services or any other material available on or from these external sites or sources. 

Furthermore, you acknowledge that the Association shall not be held liable for any damage or loss, whether proven or alleged, arising out of or in connection with the use of or reliance on the content, goods or services available on such external sites or sources. 

Finally, to the extent permitted by law, the Association shall not be held liable in the event that the content of the said other sites contravenes the legal and regulatory provisions in force. 


9. PUBLICATION BY THE USER

The site allows partners to publish information relating to an organisation or legal entity by filling in a form. The rules according to the data collected via the online form are published in the document "global database policy".


10. APPLICABLE LAW AND JURISDICTION

French law applies to this contract. In the absence of an amicable resolution of a dispute between the parties, the French courts will have sole jurisdiction to hear it.
